I really need HELP asap! Regarding unfair Termination and unemployment.Submitted by xsullengirlx on Thu, 01/19/2006 - 6:19am.
Hello everyone, I don't think this forum is very active, seeing as I only recieved one reply on my last post... But I really, really need your help. Anyone who is reading this, please give me some suggestions. This is the post I made a week ago about being unfairly terminated from Starbucks at the end of December. http://www.starbucksunion.org/node/634 I have since applied for unemployement while I search for another job (being fresh out of the Holiday season, not many places are hiring) and I recieved a letter today from the Unemployment office stating that I may not be eligible for benefits because of the reasons Starbucks listed about my termination... Let me STRESS, the things they detailed in the letter came from my old Manager himself, and were complete LIES and exaggerations. I'm completely lost on what I should do now. If you read my first post, and then continue here... This will make more sense to you. Here are the lies that Starbucks told in order to get out of saying YES to me recieving unemployment. (i worked almost a year, FYI) On the morning of the 23rd (around 10:30am), I called work to make sure it was fine that I left for Seattle. The shift supervisor said YES, it was fine. That's when I left. Starbucks told the unemployement office that I had not called, that an assistant Manager had called MY cell phone mid-day on the 23rd to tell me that my shift wasn't going to be covered. THIS is a BOLDFACE LIE. first of all, I never ONCE gave anyone at Starbucks my cell number. Secondly, even if they DID have it (which, they didnt) they did NOT call me. I have my cell phone with me at ALL times, and they NEVER called. My Manager called my house phone and left a message on the 26th, 3 days after the fact. An assistant manager, nor my regular manager, called my house OR my cell phone at ANY point before that. I was the one who made the call, and that's when i was given the green light to go. So now Starbucks and I have conflicting statements about what happened, although I have physical PROOF that they never called my cell phone at all, and only called my HOUSE one time the evening of the 26th. I have my cell phone bill that has each and every incoming and outgoing call on it. I have my parents house phone bill with the same information on it. How could I be denied unemployment because it looks like I was lying about something? I wasn't lying! STARBUCKS is the one that's lying! Starbucks also told the Unemployment officer that I had TWO prior WRITTEN warnings, when in reality I had recieved ONE VERBAL WARNING, not written. I was specifically told at the time it was a verbal warning, I did not have any papers given to me, and was told not to worry about it. (the incident was not my fault, my power along with the entire city's power had gone out that morning and my alarm did not go off, causing me to be 30 mins late for the first time in my life.) Now, what do I do?! I want to go in and talk to my old manager, but I am not sure where that might get me. I lost my job under very unfair circumstances and now I am going to be denied unemployment while I try to find another job. None of this is fair, and I am literally going into debt and sinking fast. I dont know what step to take next... It keeps getting worse by the day. I was placed under re-hireable status, but now i'm not sure I even want to go back... Even though at one point I really LOVED my job. *sigh* Please help with anything. I'm desperate. If you can't help, could you point me in the direction of someone who could? |
