I found this site after doing a search to see if anyone else was having problems with SB.

I was injured in my eye at a Starbucks by an unruly child that the manager knew about but would not/did not try to have controlled by the parents, and she did not ask them to leave either. The kids were absolutely wrecking the place, jumping all over sofas, coffee tables, annoying other patrons...but then one kid swung something and hit me in the eye, damaging my cornea.

I contacted Starbucks national, they told me to be sure to have it treated and they would reimburse my out of pocket costs. Like a fool I did it without going to my attorney first.

I sent them the bills, and now they say they WON'T pay but will send me a SB giftcard instead (oh, WOW!)

The parents and brats beat it out the door after this happened, so no hope of finding them. Legally SB is liable under their liability insurance, although they claim they're not.

My lawyer said that what they did was: have me pay my bills, then they waited to see if the bills would be high or low.

If high, they would either settle out of court or risk a lawsuit.

If low, they could risk blowing me off, knowing most ppl wouldn't sue for just 100 bucks or so.

After researching things online, I learned that a LOT of ppl have lawsuits against SB.

I would not be as shocked if this were a company like Walmart, which you expect to be uncaring due to their rep. But this was Starbucks, which POSES as a socially conscious, caring company.

Well, they have lost not only my business, but my husband's, my family's, and almost everyone I tell this incident to.

The manager kept saying "well, I can't just ask them to leave!" Yet in doing online research I learned of "Rev Bill", an anti-SB guy in NYC who goes into SB stores to sit down and tell patrons why he thinks SB is evil. They ask HIM to leave! I guess the safety of longtime customers is not an issue for them, but protecting their rep is.

Did you tell the manager immediately when you were injured?
Did the manager fill out an incident report?
If this did not happen, it would lead me to believe that Starbucks will not respond to your request for medical costs repayment. If you see it from their point of view, they have no documentation about the incident, so where is their motivation to reimburse you. They have many people claiming injury and demanding payment, it would not make business sense for them to pay just because there was a demand.

Yes, I did notify the manager right away. In fact another customer, who witnessed what happened, helped me up and brought me to the manager.

BTW since I posted my first msg, Starbucks has been in touch with me...it seems they are now going to reimburse my medical expenses and then some. I think its because I let them know I work as a reporter when I'm not in SB having something to drink.

It is, indeed, their fault. It may help if you knew the law before you insulted the poster.
